Provincial housing legislation will affect Burnaby

In November 2023, the Provincial Government enacted legislation that will significantly change housing throughout British Columbia, including in Burnaby.

These changes affect the approval process for residential projects allowing density increases beyond what has been traditionally permitted in Burnaby neighbourhoods. These changes are mandated by the Province with the intent of addressing affordability by creating more housing supply. 

As a City we want to ensure that you are aware of these changes and how they will affect the growth and character of Burnaby. 

One of the most significant legislated changes is to the number of housing units permitted on a residential lot. In most single and two-family areas, this is four units per lot, and in areas near frequent transit service this can be as many as six units per lot. The Province has also designated Transit Oriented Areas with minimum densities and heights near SkyTrain stations.

Further, as part of the new rules, municipalities are also no longer allowed to hold public hearings for residential projects that conform to the City’s Official Community Plan, which represent a majority of the rezoning applications we receive.

City staff have been actively reviewing the provincial changes and are working hard to find ways to mitigate the impacts, to ensure our city continues to grow in a sustainable way. The City of Burnaby remains committed to proactive and strategic planning to adapt to the evolving legislative landscape, to ensure that the wellbeing and needs of our residents are met.
